Pending before the Licensing Board is the November 12, 2019 hearing request of petitioners Eric J. Epstein (Epstein) and Three Mile Island Alert (TMIA) contesting the July 1, 2019 application submitted by Exelon Generation Co., LLC, (Exelon) asking the Nuclear Regulatory Commission (NRC) to amend the existing 10 C.F.R. Part 50 license for the Three Mile Island Nuclear Station, Unit 1, by revising the facility's Site Emergency Plan and Emergency Action Level scheme to reflect the reactor's permanently defueled condition.1 With the submission of answers to the Epstein/TMIA hearing petition by the NRC staff and Exelon on December 6 and 9, 2019, respectively,2 and the time for the petitioners to submit any reply to 1 [Epstein/TMIA] Petition to Intervene and Hearing Request (Nov. 12, 2019).

those staff and Exelon responses having passed without further filings,3 in accord with 10 C.F.R.
§ 2.309(j), the Licensing Board will issue a decision on the pending Epstein/TMIA hearing request on or before Thursday, January 23, 2020.
