Gentlemen:
Revision No. 5 to Certificate of Compliance No. 9044 was issued on July 15, 1980, in response to your December 4,1979, April 9 and May 7,1980 applicatiens for amendment and renewal. The April 9 and May 7, 1980 renewal applications were combined with the December 4,1979 amendment application for which a minor amencuent fee of $2,800 was paid.
In the enclosure to Revision No. 5, the Licensing staff requested additional information by October 31, 1980, and by letter dated December 23, 1980, again requested the information.
Since a response was not received, Licensing extended the expiration date of the Certificate for'l year to December 31, 1981, and closed the December 4, 1979 amendment request. We understand that Revision No. 5 is an interim approval of the December 4,1979 amendment application and that when your application is submitted responding to the Dececer 23, 1980 request, Licensing will process it as a request for a new revision to the Certificate for which an amendment fee will be due.
Since licensing action on the December 4,1979 application for amendment has been closed, we have, in accordance with Footnotes 1(d) and 4 of the enclosed 10 CFR 170, reviewed the manpower expenditures required for the review of the subject application for amendment, and the actual review fee is $1,976. We have notified the NRC Office of the Controller to refund $824 to your Company.
