FOR DISCRETIONARY REVIEW UNDER 6 2.785(d)

The Staff of the Nuclear Regulatory Commission (Staff) hereby responds to the application of Intervenors Christa-flaria, et al., (Intervenors)

I for discretionary Comission review of the decision of the Atomic Safety and Licensing Appeal Board (Appeal Board) in Consumers Power Company (Big Rock Point Plant), ALAB-636,13 NRC (March 31,1981), under 10 C.F.R. 5 2.785(d).

On May 18, 1981, Intervenors filed a document entitled "Intervenors Reply on Petition for Review of Interlocutory Order under Section 2.786, or alternatively, Application for Discretionary Review under Section 2.785(d)."

Intervenors did not specify the grounds upon which discretionary review under 5 2.785(d) is sought.

Rather, they rely upon the grounds set forth in their original petition for Commission review filed on April 20, 1981.

The Staff in its response to Intervenors' original petition for Commission review took the position that, even were this petition to be treated as a request for directed certification under 5 2.785(d), the l

certafication should be denied.

For the reasons set forth in the Staff's response to Intervenors' original petition, this 1
