Dear Sir,
4fT W Sy memorandum dated February 9, 1981, Ivan W. Smith, Administrative Judge, and Chairman, Atomic Safety and Licensing Board Fanel, responded to Chairman Ahearne's memorandum of January 22, 1981 and to Chairman Ahearne and Commissioner Hendrie's January 28, 1981 memorandum, the former having to do with possibilities for expediting the hearing and the latter requesting a best estimate of the future schedule of the proceeding.
Cne section of the referenced memorandum from Chairman Smith, entitled " Financial Capability Issues" (pp. 4-5) dwells on a suggestion of the NRC Staff that the Commission may desire to eliminate the financial issue from those issues which must be litigated prior to reaching a decision on the restart of TMI-1.
Three Mile Island Ale rt. Inc., as an intervenor in those proceedings, hereby requests that no decision be made by the Commission on the matter of retention or elimination of financial capability issues until all intervenors in the subject hearing have been afforded sufficient time to study the proposal and its implications and have had the opportunity to express their views to the Commission as to their respecti'?a I
