REQUEST FOR WITHHOLDINS I(FORMAT ON FROM PUBLIC DISCLOSURE, REFERENCE AW-80 COMALCHE PE i By your application and affidavit (identired as Westinghouse letter number NS-TMA-2337, Anderson to Tedesco, c'ated Nc ember 7,1980) you submitted copies of a proprietary version anj a non.roprietary version of 17 slides utilized in the Westinghouse propesal for.ddressing an inadvertent boron dilution event at Comanche Peak. The set ;f proprietary copies was stamped WESTINGHOUSE PROPRIETARY CLASS II, and the set of non-proprietary copies was stamped WESTINGHOUSE PROPRIETARY CLASS III.
You requested that the proprietary copies be withheld from public disclosure ; ursuant to 10 CFR 2.790.
(ot.r reasons for requesting our withholding of this information were:
1.
The information sought to be withheld from public disclosure is owned and has been held in confidence by We tinghouse.
2.
The information is of a type customar-ly held in confidence by Westinghouse and not customarily disclosed to the t.ublic.
3.
The information is being transmitted to the Commission in confidence and, under the provisions of.10 CFR Section 2.790, it is to be received in confidence by the Conunission.
4.
The infonnation is not available in ptolic sources to the best of our knowledge and belief.
5.
The proprietary information sought to be withheld in this submittal is that which is appropriately marked in the attachment to Westinghouse letter number NS-TMA-2337, Anderson to Tedesco, dated November 7, 1980.

(b) Westinghouse sells analyses and :he resulting electronic devices.
Public disclosure of this informatict concerning analysis methods and functional requirements is likely to :ause substantial harm to the competitive position of Westingnouse aecause competitors could utilize this information to assess and justity their own designs without connensurate expense.
The parametric analyses performed anc their evaluation represent a considerable amount of highly qualifi 2d development effort. This work was contingent upon a program which hs been underway for the past four months. Altogether, a substantial ar;unt of money and effort has been expended by Westingnouse which could snly be duolicated by a comoetitor if he were to invest similar sums of.oney and providt:d he had the appropriata talent available.
We have reviewed yc ar application and mate ial based on the reouirements and criteria of 10 CFR 2.790 and have dete mined that the above-mentioned slides sought to be vithheld contain confi.ential or proprietary commercial information.
We also have found at this time that the r ght af the public to be fully apprised as to the bases for and effects c# the proposed action does not outweigh the demonstrated concern for protection of your competitive position.
Accordingly, we have determined that the ifonnation snould be withheld from public disclosure.
We, therefore, approve your request for wi:hholding pursuant to Section 2.790 vf 10 CFR Part 2, and are withholding the,coprietary copies of 17 slides utilized in the Westinghouse proposal for 3ddressing an inadvertent boron dilution event at Comanche Peak from public inspection as proprietary.
Withholding from public inspection shall n->
affect the right, if any, of persons properly and directly concerned to inspect the documents.
If the need arises, we may send copies of this in ormation to our consultants working in this area. We will, of course, assure that the consultants have signed the appropriate agreements for hanc~ing proprietary data.
