Bailly Nuclear Generating Station

Dear Sirs:

On June 5, 1980, the City of Gary, Indiana, United Steel-workers of America Local 6787, the Bailly Alliance, Save the Dunes Council and the Critical Mass Energy Project joined in the State of Illinois' request for action to suspend or revoke the construction permit for the Bailly nuclear power plant.

That request was based upon the necessity for a consideration of whether the populations surrounding Bailly can be evacuated within a reasonable period of time in the event of a nuclear accident.

On November 20 1980, the Atomic Safety and Licensing Appeal Board upheld the denial of intervention to the City of Gary, 7or et d.

in the pending construction permit extension proceedings Bailly,in which the Gary petitioners also sought to raise the issue of whether the Bailly site remains feasible from an evacuation perspective.

If the Appeal Board is correct, a section 2.206 proceeding is the only available forum for deciding before l

Bail 1y is built whether it is being, built in a safe place.

For this reason, the City of Gary, et al. are filing the attached supplement to their request for 7ctTon.
