APPEAL BOARD MEMORANDUM'AND ORDER RE: COMANCHE' hEAK DATED NOVEM ER 24. 1980 On November 24. 1980 the Appeal Board issued a Memorandum and Order in the Comanche Peak 1&2 operating license proceeding regarding an appeal filed by an intervenor in that proceeding. Citizens for Fair Utility Regu-lation(CFUR). In ahiitting CFUR as an intervenor in this proceeding, the Licensing Board accepted several of CFUR's contentions as litigable and rejected others. CFUR sought to appeal the rejection of one of its con-tentions. The Appeal Board summarily dismissed this appeal on the ground that the NRC Rules of Practica do not permit a person to take an inter-locutory appeal from an order entered on his or her intervention petition unless that order has the effect of denying the petition in its entirety.
