ISSUANCE OF EFFECTIVE AMENDMENT T0 10 CFR PART 50 APPENDIX E

" EMERGENCY PLANS FOR PRODUCTION AND UTILIZATION FACILITIES" We have reviewed the subject Commission paper and we have a problem as it relates to fuel cycle facilities licensed under 10 CFR Part 50.

In the licensing of fuel cycle facilities we do not use 10 CFR Part 100 limits. These limits were developed for and apply only to nuclear power reactors.

For this reason, we recommend that a paragraph be added at the end of paragraph I of 10 CFR 50, Appendix E, to read as follows:

"For nuclear power reactors, provisions for emergency protective measures to reduce exposures from an accidental release of radioactive materials shall be considered, at a minimum, within the low population zone (LPZ) as specified in 10 CFR Part 100.

The extent to which emergency planning should be extended to areas beyond the LPZ shall be based on the design features of the facilities and the principal characteristics of the environs in the vicinity of the site taking into account the emergency action criteria development in cooperation with appropriate federal, state and local governmental authorities."

With this change, we concur in the Commission paper.
