NRC STAFF RESPONSE TO INTERVENORS' MOTION FOR A STAY OF PROCEEDING I.
INTRODUCTION On September 11, 1980, the Applicant, Puerto Rico Electric Power Authority, filed a document entitled " Motion for Termination of Proceeding" accompanied by a document with the same date entitled " Withdrawal of Application."
On September 18, 1980 the Intervenors filed before the Commission a document entitled " Motion for Direct Certification to Request Application Be Dismissed with Prejudice" and on the same date filed before the Licensing Board its
" Motion for a Stay of Proceedings."
In the latter motion Intervenors request that the Licensing Board issue immediately an order to stay the proceeding until 15 days after the Commission rules on Intervenors' motion for directed certification. As set out in the Staff's response to the motion for direct certification, the Staff believes that motion is without merits and certification should not be granted. However, the Staff does believe it appropriate that this Licensing Board take no action 010 40${r$

i 2-in this proceeding and particularly on the motion to terminate the proceeding until the Commission has had an opportunity to act on the request for directed certification which involves the terms upon which this proceeding might be terminated.

.For these reasons the Staff does not oppose the motion to stay proceeding before this Board, until the Commission acts on the motion for direct certi-fication.
