Your letter of September 17, 1980 to Chairman Ahearn an early hearing date ih the Allens Creek Construction 7-O Permit proceeding has been referred to the Office of the General Counsel for reply.
A recant development has affected the scheduling of the hearing about which you inquired.
To give you a general background of that proceeding, I would only note that it has been and is one of the most complex licensing proceedings undertaken by the Commission in terms of the number of intervenors and issues in controversy.
As a result of this intervention, pre-hearing discovery has been lengthy and detailed requiring tremendous resources and time from all parties and the Licensing Board.
At the conclusion of the discovery period, the Licensing Board determined that a prehearing conference would be in order to discuss the status of the proceeding, the schedule for summary disposition and, ultimately, the h 3aring schedule.
"'he prehearing conference was held in Houston on August 13, 1980 wherein the above matters were discussed.
With respect to a hearing schedule, the Licensing Board determined that due to an apparent conflict in hearing schedules by one or more of the members assigned to the Allens Creek Licensing Board, the hearing could not commence until mid-January 1981.
Due to tihe possible settlement of another NRC proceeding, all of the Board Members of the Allens Creek Construction Permit Hearing Board will be available on a date earlier than previously anticipated.
On September 17, 1980, the Board issaed an order requesting comments on a proposed revised hearing schedule for Allens Creek to begin December 1, 1980 rather dan the previously scheduled mid-January 1981 date.
Although the hearing date has not yet been moved, the availability of Licensing Board members is no longer a reason for delay in thi's proceeding.
A copy of the order is enclosed for your information.
