Dear Congressman Studds:

I am pleased to respond to your inquiry of September 8,1980, concerning j

a letter from Mr. Fred Straut of Baker Testing Services, Inc., Hingham, Massachusetts. Mr. Straut asked why the Nuclear Regulatory Comission assesses charges for inspections when the agency is a tax supported institution.

The Comission assesses fees for inspections pursuant to the provisions of Title V of the Independent Offices Appropriation Act of 1952 (10AA). Title V provides in pertinent part:

It is the sense of Congress that any work, service, publication, report, document, benefit, privilege, authority, use, franchise, license, permit, certificate, registration, or similar thing of value or utility performed, furnished, provided, granted, or 4

issued by any Federal agency to or for any person...shall be self-sustaining to the full extent possible, and...each Federal i

agency is authorized by regulation to prescribe therefor such fee, charge, or price, if ey, as he shall determine....and any amour.c so determined or redetermined shall be collected and paid j

fr.to the Treasury as miscellaneous receipts.

1 All monies collected by the Comission for licensing or inspection activities are fonvarded to the U.S. Treasury as miscellaneous receipts. The fee in question covers the Comission costs of conducting a routine health and safety inspection of the activities authorized by NRC License No. 20-19067-01 held by Baker Testing Services, Inc. The Comission's inspection program is based on the precept that nuclear quality requirements are mandatory and enforceable under Federal law.

Inspections are designed to ensure that licensees conduct programs involving the use of radioactive materials in a manner that adequately protects the health, safety, and security of the public and the environment in which they live.

The routine inspection program is structured so that certain elements of the licensee's authorized activities -(involving personnel, procedures, operations, fu iiities, materials and equipment) are inspected at a prescribed frequency.

The scheduling and frequency for inspection against the various requirements for each licensee depends upon the scope and complexity of the licensed prog.7m.

The Honorable Gerry E. Studds Radiography programs are nonnally inspected at a frequency of once per year.

If the licensee is not inspected during this period, no fee is assessed. On the other hand, if more than one inspection is required during a year, the itcensee would be required to pay for one inspection only ($980).

Is it comon practice for the NRC to' require that firms pay for audits of their own 2
