The only participation to this date by Rorem, et al. has been to file contentions. Rorem, et al. have requested no discovery and have repeatedly failed to answer discovery requests and fai'ad to comply 1
with orders to compel answers to discovery. The persons represented by Rorem et al. apparently have nothing to contribute as a party and merely wish to participate as observers with a right to cross examine 1
