MEMORANDUM AND ORDER Upon consideration of the application of petitioner, Fairfield United Action, for a stay pending review of ALAB-642 (South Carolina Electric and Gas Co., et al. (Virgil C. Summer Nuclear Station, Unit 1)), ALAB-642 (June 1,1981), O the responses thereto, the relevant Appeal Board deci-sions and other pertinent filings in this proceeding, the Commission is of l
E The Appeal Board recognized that it would be difficult, if not impossible, for FUA to present its request for a stay before the Commission prior to the upcoming hearing. As an accommodation to FUA, it transmitted the relevant filings to the Commission for consideration as the Commission i
saw fit. The Commission has, en its own motion, elected to treat peti-tioner's application before the Appeal Board as an application for a stay to the Commission under 10 CFR 2.788.
The responses to that appli-cation have also been considered as filed with the Comnission. The office l
of the General Counsel has been informed that a mo. tion by FUA for a stay is in the mail.
However, the ~ Commission has decided i.o act on the basis of filings currently before it. Since the hearings are scheduled for June 22, an expedited decision is necessary.
