ORDER (Denyino NRC Staff's Motion to Strike)
On June 4,1981, NRC Staff moved,to strike FUA's May 27, 1981 response to sumary disposition and May 28, 1981 prefiled testimony. The Board has taken'FUA's response to sumary disposition into account in ruling on the motions for sumary disposition since Intervenor Bursey incorporated that response by reference.
In view of the Appeal Board's having denied FUA's participation in the proceeding a#ter the-date for filing the prefiled testimony had passed, fairness requires that we permit the remaining intervenor to utilize whatever of FUA's testimony he desires. Staff and Applicants have had sufficient time to prepare cre m -examination and rebuttal regardless of which party submitted the testimony.
If either Staff or Applicants desire a continuance to further prepare for the testimony because of the late date of this Order, a motion to that effect will be entertained by the Board at the tiary hearing.
