' Costa. Mesa, California.92626 As a result of-the inspection conducted on March.. 23, 1981, and in accordance with the Interim Enforcement Policy, 45'FR 66754 (October 7,1980), the following violation was identified:
'A.
'10= CFR' 32.29(c) requires that an annual report must be filed with the
. Director of fluclear Material Safety and Safeguards,'U. 5. fluclear.
Regulatory Comissio Washington, D. C. 20555, with a copy to the flRC
' Region V. office, whicn shall include'the following information on products-transferred to other persons for use under 10 CFR 30.20:
(1) A description or identification of the type of each product; (2) for each radionuclide in each type of product, the' total quantity of radio-nuclide and (3) the number of units of each type of product during the reporting period. The report shall cover the year ending June 30, and shall be filed within 30 days thereafter.
(1) Contrary to this requirement, the annual report for the year ending June 30, 1979, was not filed 'until January 28, 1980.
(2) Contrary to this requirement, at the time of the inspection, the
. annual report for the year ending June 30, 1980, had not been filed with the Director of fluclear Material Safety and Safeguards and the Region V office.
These items constitute a Severity Level VI violation (Supplement VII).
Pursuant to the provisions of 10 CFR-2.201, Gateway Scientific, Inc., is hereby required to submit to this office within twenty-five days of the date of this flotice, a written statement or explanation in reply, including:
(1) the ~ corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further items of noncompli-ance; and (3) the date when full compliance will be achieved.
