The following information is submitted in response to the Notice of Violation included in your letter of May 14, 1981, which addressed Inspection Report 81-09. Two apparent violations were identified.

Statement of Violation Technical Specification.6.8.1 requires that written proc *edures shall be established, implemented, and maintained covering the procedures recommended in Appendix A of Regulatory Guide 1.33.

Regulatory Guide 1.33, Appendix A, states in part that safety-related activites should be covered by written procedures.

Plant procedure HNP-804, Equipment Storage, paragraph C.1 requires that all items to be maintained in storage will be divided into four levels with respect to the protective measures required to prevent damage, deterioration or contamination of the items.

Contrary to the above, a storage level for the high density fuel storage racks was not designated.

Resoonse 1.

Admission or denial of the alleged violation:

The violation occurred as stated.

The reasons for the violation:

The violation occurred because of inadequate procedures which failed to address any temporary storage areas or assign a storage level for the high density fuel racks.

3.

The corrective steps which have been taken and the results achieved:

The subject fuel racks have been covered to prevent any damage from the environment.

Additionally, the fuel racks will be cleaned and verified for proper boral poisoning function prior to use.

Procedure reviews are presently being performed to address and correct procedural inadequacies noted in this' violation.

Deficient procedures identified in the above procedure review will be revised to prevent recurrence of this violation.

The date when full compliance will be achieved: Revised procedures will be in place by August 1, 1981.

Statement of Violation 10 CFR 50, Appendix B, Criterion XVI, implemented by Hatch Quality Assurance Manual, Section 16, Paragraph 16.1, states in part that measures shall be established to assure that conditions adverse to quality are promptly corrected.

g Contrary to th.e above, a condition adverse to quality, the deterioration of the protective coverings over the storec high density fuel racks, was

  • not promptly corrected.

Although identified by Hatch Nonconformance Report No.81-223, dated 2/18/81, and as an NRC concern on 3/13/81, the item was still uncorrected on 3/20/81

The violation occurred because of failure to establish a time when corrective action had to be taken. This was due to a procedural inadequacy.

The corrective steps which have been taken and the results achieved:

Procedure reviews are presently being performed to address and correct the inadequacy noted in this violation.

4.

Corrective steps which will be taken to avoid further violations:

Deficient procedures identified in the procedure review will be revised to prevent further violations.

Report Nos. 50-321/81-09 and 50-366/81-09 This refers to the routine safety inspection conducted by Mr. R. F. Rogers of this March 27, 1981, of activities authorized by NRC office on February 21, Operating License Nos. OPR-57 and NPF-5 for the Hatch facility. Our preliminary findings were discussed with Mr. R. Moore at the conclusion of the inspection.

Areas examined during the inspection and our findiegs are discussed in the enclosed inspection report. Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observations by the inspector.

During the inypection, it was found that certain activities under your license appear to violate NRC, requirements. These items and references to pertinent requirements are listed in the Notice of Violation enclosed herewith as Appendix A.

Elem'ents to be included in your response are delineated in Appendix A.

Duri* rig the inspection it was found that certain activities under your license appear to deviate from commitments to the Commission and have safety signifi-cance. This item is identified in the Notice of Deviation enclosed herewith as Appendix B.

Please provide us in writing your comments including a description of corrective actions that have been or will be taken, corrective actions which

will be completed.

APPENDIX A NOTICE OF VIOLATION Docket Nos.50-32i and 50-366 Georgia Power Company Hatch 1'and 2 License Nos. DPR-57 and NPF-5 As a result of the inspection conducted on February 21 - March 27, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980),

tne following violations were identified.

A.

Technical Specification 6.8.1 requires that written procedures shall be established, implemented, and maintained covering the procedures recommended in Appendix A of Regulatory Guide 1.33.

Regulatory Guide 1.33, Appendix A, states in part that safety-related activites should be covered by written procedres.

10 CFR 50, Appendix 8, Criterion XVI, implementec' by Hatch Quality Assurance Manual, Section 16, Paragraph 16.1, states in part that measures shall be i

established to assure that conditions adverse to quality are prcmptly corrected.

Contrary to the above, a condition adverse to quality, the deterioration of the protective coverings over the stored high density fuel racks, was not promptly corrected. Although identified by Hatch Nonconformance Report No.81-223, dated 2/18/81, and as an NRC concern on 3/13/81, the item was still uncorrected on 3/20/81.

Pursuant to the provisions of 10 CFR 2.201, you are hereby required to suomit to this office within twenty-five days of the date of this Notice, a written state-ment oc h planation.in reply, including: (1) admission or denial of the alleged violations;,2) the reasons for the violations if admitted; (3) the corrective steps whica nave been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.

APPENDIX B NOTICE OF DEVIATION Georgia Power Company License Nos. OPR-57 & NPF-5 Based on the results of the NRC inspection conducted on February 21, -March 20, 1981 certain of your activities appear to deviate from (your commitements to the Commission), as indicated below.

On June 12, 1980, the NRC issued IE Bulletin 80-14, Degradation of BWR Scram Discharge Volume Capability, which required in. paragraph A3 that. procedures be implemented to assure that, through periodic testing, the Scram Discharge Volume (SDV) vent and drain valves are periodically tested. The licensee response dated July 25, 1980 stated that these valves would be tested monthly.

Contrary to the above, no procedwal requirement nor documentation exists which shows that these valves see periodically tested as stated.

This is a Deviation and is applicable to Units 1 and 2.

SUMMARY

Inspection on February 21 - March 27,1,981 Areas Inspected This inspection involved 83 inspector-hours on site in the areas of technical specification compliance, housekeeping, operator performance, overall plant operations, quality assurance practices, station and corporate management practices, corrective and preventive maintenance activities, site security procedures, radiatien control activities, surveillance activities and IE Bulletins and Circulars.

Results Of the 10 areas inspected, no apparent violations or deviations were identified in eight areas, two violations were identified in one area (Protection of Spent Fuel Pool High Density Racks - Nragraph 6), one deviation was identified in one area (Failure to conduct operability cnecks on SDV vent and drain valves as committed paragraph 10).
