essman Walker I have been asked to respond to your letter to Chairman Eendrie of April 1 because of a concern that your comments on. the Com-mission's March 23 decision to re=ove the financial qualification issue frem the '"hree Mile Island Unit i restart proceeding may be improper under the Pillsburv doctrine.

That doctrine is dis-cussed in the enclosed me=crandum to Chairman Eendrie of March 28, 1979.

With respect to the general question of whether financial quali-fication issues should be litigated in the NRC hearint crecess, the Commission's March 23 order indicated t*at the Com.lission 2.s reexamining the matter.

The Commission inte. ads te develop and issue for public cocment a rule which woutd eliminate or reduce the financial qualifications review for power reactors because in some areas that review oces not appear to be meaningful.
