Dear Mr. Risk:
This is in response to your recent letter inquiring about the restart of TMI-1.
Unit 1 was down for refueling at the time of the accident at TMI-2 in late March 1979.
On July 2,1979, the Commission ordered that the facility remain in cold shutdown until further order of the Commission, stating that "the Commission presently lacks the requisite reasonable assurance that the.
Licensee's Three Mile Island Unit No. 1 Facility..can be operated withqut endangering the health and safety of the public." Further, the Commission stated that public hearings would be conducted to determine whether TMI-1 should be allowed to resume operation and, if so, under what conditions.
In a subsequent order issued August 9, 1979, the Commission established pro-cedures for the hearings and decision on the issues.
The hearings began before an NRC Atomic Safety and Licensing Board (ASLB) in Harrisburg, Pennsylvania on October 15,'1980.
While we are, of course, concerned about financial impacts on consumers and stockholders, the NRC's primary responsibility is the assurance of public health and safety through a fair and thorough hearing and decision.
The rec-ord on which the Commission will make a final decision will include findings and conclusions by the ASLB.
Because of the unique nature of the proceeding and the broad spectrum of issues under discussion, it is difficult to provide a definitive schedule for a decision at this time.
The NRC staff is actively involved in the ongoing review of technical issues concerning the restart of Unit 1 and activities associated with the. cleanup of Unit 2.
