Dear Mr. Handley:

Subject:

Modification No. Nine (9) to Contract No. NRC-10-76-334; Federal Prison Industries Pursuant to the Economy Act of 1932, as amended, the U.S. Nuclear Regulatory Commission (NRC) and the Federal Prison Industries (FPI) desire to modify the subject Interagency Agreement to extend the period of performance.

Accordingly, upon your agreement as provided below, the terms and conditions of the subject Interagenc" Agreement are revised as set forth below:

1.

Article I Period of Performance - Effective September 30, 1980, the period of performance is hereby extended through September 30, 1981.

2.

Article III - Estimated Cost and Obligation of Funds - The total NRC obligations hereunder remain at 583,300.00.

It is estimated that the amount currently obligated with respect to this agreement will cover performance of services required through the month of March 1981. Additional funding for the balance of FY 1981 shall be provided subject to the availability of NRC's FY 1981 appropriation.

3.

Article VI - Payment, is revised to inc16de the following paragraph:

"For services to be performed from October 1,1980 through September 30, 1981, the NRC will reimbuse FPI at rates to be mutually agreed upon by the parties hereto and which shall be incorporated herein prior to expiration of FY 1981. Until such rates are incorporated herein, the NRC shall continue to reimburse FPI at the rates reflected herein for the period October 1,1979 through September 30, 1980."

All other terms and conditions of the subject Interagency Agreement remain unchanged.
