hereby move the Board to enter an order, purauant to 10 CFR 52.740(e)(3), which imposes on NIPSCO and the NRC staff the duty

,to supplement all discovery responses, as more fully set forth below.

An order imposing a duty on NIPSCO and the staff to supplement discovery responses is particularly appropriate in this proceeding because the operative facts are in a constant state of flux (see Porter County Chapter Intervenors ' Motion to Suspend Liti-gation Proceedings, filed November 13, 1980), and because, by the time of the hearing, discovery responses will have been made many months earlier., some as long ago as September 1980. No party will be harmed or prejudiced by such aiFsydeE' and its . .

entry will obviate a continuing need to request clie 'updatihg of each discovery reponse.

Porter County Chapter Intervenors further request that the order sought by this motion be made applicable to discovery responses which have already been made, and to all future dis-covery responses, by NIPSCO and the staff. The ' order should specify a time for discovery responses to be supplemented.

Porter County Chapter Intervenors suggest that a reasonable time would be within 30 days of the existence or discovery of the supplementary document or information.
