Because Pacific Gas and Electric Company refuses to l

' meet its discovery obligations in this case pending resolution of the Joint Motion of Pacific Gas and Electric Company and the l

NRC Staff to Suspend Discovery and Motion Activity, the Department of Water Resources is concerned about any delays in the disposition of that motion.

Accordingly, the Department of Water Resources asks that the Atomic Safety and Licensing Board either summarily deny the motion or set a prehearing conference for the earliest date convenient to the board.
