Dear Mr. Schwencer:

1 refer to your letter of March 16, 1981 and a request for information on the presence of federally listed threatened or endangered species at the construc-tion site of the Enrico Fer=1 Nuclear Station, Unit 42, in Monroe County, Michigan.

A review of the North Central Region Red Bock of Endangered Species indicates no listed species are likely to be found within the project area.

The abov: statement may be incorporated into the Environmental Impact Statemaat you are i reparing as part of the operating license review.

Since co.struct Lon of the project. ras begun prior to November 0,1978 the Nuclear Regulatory Commission (NRC) would be exempt from conducting a biological assessment. The NRC, however, is not exempt from the requirements of the Endangered Species Act of 1973 which states in Section 7(a) that "each Federal agency shall, in consultation with and with the assistance of the Secretary, insure that any action authorized, funded, or carried out by such agency does not jeopardize the continued existence of any endangered or threatened species or result in the destruction or adverse modification of their designated critical habitat."

This letter provides comment only on the endangered species aspect of *.he project.

Comments on other aspects of the project under the authority of and in accordance with the provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et, seq.) may be sent under separate cover.
