IMPOSITION OF CIVIL PENALTIES - $7,050 pp4 By EN-80-55, dated December 11, 1980, the Commission was notified of the intent of IE to ' '-x No"ce of Violation and Notice of Proposed Imposition of Civil Penalties in of Seven Thousand Five Hundred Fifty Dollars to Pharmatopes, Incorporated.

.ne proposed penalties were based on alleged items of noncompliances relating to the radiation protection program at the licensee's Washington, DC radiopharmaceutical dispensing facility. These ite:;s involved an extremity exposure of an individual, failure to report the exposure, failure to perform adequate radiation surveys, failure to properly instruct individuals, failure to properly survey packages before shipment and failure to follow laboratory rules incorporated in the license.

The licensee responded to the Notice in a letter dated January 6,1981. After consideration of the licensee's response, the IE staff has concluded that the items of noncompliance did occur and, except for one item, no adequate reasons were given by the licensee for mitigation or remission of the proposed penalties.

The penalty for one item (the item assor.iated with personnel training) was remitted in its entirety. Accordingly, an Order Imposing Civil Penalties in the amount of Seven Thousand Fifty Dollars has been issued today. The licensee and the State of Michigan are being informed by telephone.

Since this matter involves remission of one of the items, a news release will be

issued about the time the licensee is informed.

Under the terms of the Order, the licensee may within 25 days of the date of the Order, pay the civil penalties or request a hearing.
