NRC' STAFF REJ0INDER TO MOTION OF SUNFLOWER ALLIANCE, INC., ET AL.

-On March 26, 1981 Counsel for Petitioners' Sunflower Alliance, Inc.,

et al., filed a motion to extend time so that he may file a response to the Applicants' opposition to the petition to intervene.

The undersigned Staff counsel and Mr. Wilt, Counsel for Sunflower, et al., discussed this motion and the NRC's rules and procedures on Tuesday, March 31,1981 at 1:30 p.m.

Mr. Wilt's motion was designed to

-protect his rights-to rebutt the Applicants and to rebut the NRC Staff when he gets its' reply to his petition.

It is understood that Mr. Wilt will have an opportunity at the prehearing conference to respond to the Applicants and to the Staff and thus 'no action should be taken upon the motion. Given this construction of his rights, Mr. Wilt concurs with the recommendation that the Licensing Board consider his motion moot.

- The Staff recommends that no action be taken by the Licensing Board on Mr. Wilt's motion to extend time dated March 26, 1981.
