Dear Sir:

In reference (d), Vercent Yankee presented our position stating that we

~ believed Vermont Yankee met the intent of Item 3.2.4 (Primary Containment Analysis) of Re ference (c).

Recent conversations with members of your staff have indicated that this position is unacceptable.

Because of the sta ff's refusal to accept our position, Vercent Yankee nust reques t an exemption to the requirements of Item 3.2.4 of Reference (c) in accordance with 10CFR 50.12.

Item 3.2.4 of Reference (c) required that an oil collection system be provided for reactor coolant pumps inside primary containment if the containment atmosphere is not inerted during station operation. Vernon t Yankee is not presently required to maintain an inerted containment atmosphere, therefore, this requirement would apply to our facility under normal conditions. However, Reference (b), when implemented, will require Vernont Yankee to inert. It should be evident that. there is little benefit to be gained frc'n Vermont Yankee's commitment to a schedule for installing a modification at this time when pending regulation will render that

. modification unnecessary. In fact, there exist substantial disincentives in terms of unnecessary personnel exposure and other cos ts which would be passed on to the consumer should this modification be required before Reference (b) is implemen ted.

6 Un ited States Nuclear Regulatory Commiss ion March 17, 1981 Office of Nuclear Reactor Regulation Page 2 In view of the information presented above, in addition to the fact that standpipe and hose stations are available and equipped to provide fire su ppr es s ion to areas within the primary containrent if necessary, Vermont Yankee requests an exemption to allow continued operation in the present mode until such time as the pending regulation becom s effective.

Because th e issuance of this regulation is entirely dependent on the NRC, we are unable to provide a de finite schedule for the final resolution of this item at th is time.
