Subject:

Withholding Infomation From Public Disclosure - CAW-81-68 NSSS Setpoint Methodology By SNUPPS transmittal letter,' dated August 20, 1981, we received your. application and affidavit, dated August 17, 1981 and December 2,71976, respectively for material concerning setpoint methodology. The letter requested that this-material be withheld from public disclosure pursuant to 10 CFR '2.790.

Your reason for requesting our withholding this infomation was that material of the same technical type was previously submitted by Westinghouse'on the:

D. C. Cook Unit 2 docket (50-316) and was approved as proprietary and withheld ~

from public disclosure on' April 17, 1978.

The setpoint methodology material submitted responds to NRC questions for SNUPPS on the Callaway 'and Wolf Creek dockets and is similar to that submitted -

for D. C. Cook and is not available in public sources and was transmitted to' the Connission in confidence. Th, infomation enables Westinghouse to assist its customers to obtain licenses, meet warranties, justify the Westinghouse design and increase power capability or operating cargin. for plants while' assuring safe and reliable operation. Public disclosure of this information is likely to-cause substantial harm to the competitive position of Westinghouse

. since competitors could utilize the infomation to justify their own designs without expending co7mensurate costs.

We have reviewed the material submitted and based on the requirements and criteria of 10 CFR 2.790 have determined that the above-mentioned documents sought to be withheld contain trade secrets or confidential or proprietary commercial information.

Uithholding from public inspection shall not affect,the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises we may send copies of this infomation to our consultants working in this area. We will, of cour e, assure that the consultants ?. ave signed the appropriate agreements for handling proprietary data.

If the basis for withholding this infomation fro 1 public inspection should change in the future such that the infomation could then be made available for public inspection, you should pronptly notify the NRC.
