50-360 ORDER TERMINATING FACILITY LICENSE By application dated April 20, 1981, Battelle Memorial Iristitute requested termination of Facility License CX-26 for the Plutonium Recycle Facility (PRCF) now Richland, Washington. The tems and conditions of Facility License CX-26 specify tb t the facility license will expire automatically upon tennination of the licensee's authority under Contract AT(45-1)-1831 (use permit) between the Commission (now DOE) and the licensee.

In accordance with the terms and conditions of Facility License CX-26, this license has expired.

Since the PRCF is a government-owned facility in e custody of Battelle under its operating contract with the Department sf Energy, all responsibility for health, safety and radiation protection is now under the control of the Department of Energy.

Therefore, pursuant to the application by Battella Memorial Institute, Facility License No. CX-26 is hereby tenninated as of the date of this Order.

For further details with respect to this action, see (1) application for temination dated April 20, 1981. This application is available for public inspection at the Commission's Public Document Room,1717 H Street, N.W.,

Washington, D.C.
