Pursuant to Item 17b of our input to the Final Environmental Impact Statement for the Dawn Mining Company Mill Tailings Expansion Project (Condition No. 34b of DSHS License Amendment No. 4), Dawn has submitted additions to the quality assurance and construction specification details for the below-grade tailings project earthwrk (letter to the earthwork contractor, E. R. Fegert, Inc., dated January 12,1981).
In addition, minor proposed changes to the existing material gradation specifications were submitted by letter dated March 9,1981, to Mr. D. G!llen of my staff.
A review of the additional earthwork specifications has shown that they provide requirements in accordance with standard practices used in the

engineering control of earthwork. We recomend that DSHS amend License ll Condition No. 37 to add " Addendum #5, Contract No. C-1, letter dated l:
January 12, 1981, from J. E. Thompson, Dawn Mining Company, to E. R. Fegert" ll to the list of technical ccntrol documents.
Dawn should be required to submit the results of all testing of the earthwork to you for review as part of the construction report required by License Condition No. 24 of DSHS License Amendment No. 4.
The March 9,1981 letter proposed gradation changes to both the drain pipe filter and cover sand materials where they are to be placed on the pit side slopes. Dawn's reason for these changes is that since the side slopes are required to be chemic lly stabilized with coherex, their drainage effective-ness will be eliminated and gradation requirements could be relaxed. Mr. Jack Thompson, Dawn Mining Company, clarified the proposed changes as follows:

There would be no changes to the gradation requirements for the drain pipe filter. The change proposed in the letter was ir error.

The gradation requirements for the cover sand that will be placed on the pit bottom would not change from that reported in " Contract No. C1, Excavation and Lining, Tailings Disposal Project."

The gradation requirements for the cover sand that will be placed on the pit side slopes and stabilized with coherex would be modified to allow up to 15 percent of material finer than the Number 200 sie m.
The prcposed change to the gradation of the cover sand on the pit slopes has been found acceptable by the Uranium Recovery Licensing Branch staf#
We recomend that an appropriate amendment of the license be made to ines-porate the material gradation modification.
