NOTICES OF VIOLATION FOR TRANSPORTATION OCCURRENCES q
This is to inform the Commission that Notices of Violation will be issde'd' to' thed '
subject licensees on or about May20,1981.
These actions are based on ali ~
violations involving NRC transportation requirements during transport of Low Specific Activity (LSA) waste to commercial waste disposal sites. The violations include:
radiation levels in excess of NRC/00T requirements on the exterior surface of a transport vehicle (NSPC); transporting leaking containers of LSA materials that were not shipped in strong tight packages (UNC and JCPL); transportation of packages containing LSA material that were breached but not leaking (PECO); failure to stablize LSA material which resulted in a lid blowing off a waste drum because of gaseous hydrogen pressure buildup (Honeywell); and failure to properly identify on shipping papers the radioactive materials being transported (UNC and JCPL)
All of the above violations were considered for NRC civil penalty actions. However, the States of Nevada and Washington, where the commercial burial sites are located, took enforcement action by immediately suspending each licensee's burial permit.
Notices were also issued by the States requiring each licensee to improve its quality assurance program and to provide the corrective actions taken to ensure that the violations will not recur.
In view of the, prior enforcement actions by the States, and because of the low hazard involved with shipments of LSA material, the staff has elected to use Notices of Violation, issued at the headquarters level, in lieu of Civil Penalties in these cases. Any future repeat violations of the same basic requirements by these licensees will be considered by the NRC for civil penalty actions, regardless of any. State actions.
Net.; releases will not be issued for the Motices of Violation.
The respective States will oe notified (Rhode Island, Pennsylvania, Minnesota and New Jersey).
It should be noted that the licensees have not been specifically informed of the e.'forcement actions.
The schedule of issuances and notifications is:
