Dear Mr. Devine:
This responds to your request for information on the status of the Nuclear Regulatory Commission's (NRC) performance appraisal systen, mandated by the Civil Service Reform Act of 1978.
Your specific questions are repeated below with our replies.
Ques tion 1.
If your agency's performance appraisal plan has not been submitted to OPM for approval, when will it be submitted?
Reply 1.
The NRC performance appraisal system for non-bargaining unit employees was submitted to the Office of Personnel Management (OPM) on
- 4 arch 16, 1981. We have been advised that OPM approved this system on April 20,1981. As indicated in the ' reply to question 3, the NRC per-formance appraisal system for bargaining unit employees is under negotiation.
Question 2.
What specific implementation instructions and guidance have you issued to your regional offices, field installations, and component agencies ? If you have not issued such materials, by what date do you intend to do so?
Reply 2.
We distributed NRC Manual Bulletin 4152 " Performance Appraisal System (non-SES)" containing agency instructions and guidance applicable to non-bargaining unit employees throughout NRC, including Regional Offices, during the last week of March 1981.
Question 3.
Have your component agencies, regional offices and field installations been reminded of tFeir collective bargaining obligations and are they aware of the need te begin bargaining at the earliest possible time so as to meet the statutory implementation date of October 1,1981?

Reply 3.
NRC Headquarters has the responsibility for bargaining with the National Treasury Employees Union, which has exclusive recognition, on a nationwide basis, for all bargaining unit employees in this agency.
NRC began negotiations with the union on employee participation in the performance appraisal process on April 2,1981, and on the entire performance appraisal system on April 21, 1981. However, no agreement has been reached.
This lack of agreement may become a major obstacle in terms of timely implementation of our performance appraisal. system.
Question 4.
Have you begun to develop elements and standards for the merit pay and general employees of your agency? What percentage of your merit pay employres are now covered? What perccntage of your non-merit pay employees are now covered?
Reply 4.
NRC is not covered by the merit pay provisions of the Civil Service Reform Act.
Formal trai..ing of supervisors in developing elements and standards started in March. Trained supervisors have begun to develop elements and standards.
In additie m, some prototype elements and standards for similar or identical positions (e.g., secretaries) are being developed.
Non-bargaining unit employees covered by the approved performance appraisal system represent about one-third of total NRC ' staff.
Question 5.
What target date have you established for completion of elements and performance standards for both groups?
Reply 5.
The target date for completing performance elements and standards is no later than October 1,1981, the statutory deadline.
As our responses indicate, I believe NRC is moving ahead, on schedule, to implement its performance appraisal system.
