Dear Congressman Goodling:

b Ms. Hocker's letter of March 11, 1981, concerning limited appearance statements in connection with the Three Mile Island Unit 1 Restart Hearing was forwarded to me on March 26, 1981.

I regret that a four day illness has delayed th'is response.

.Ms. Hoc.ker attended the March 5 evening session for limited appear-ance statements. When called upon by the Board, she yielded her turn to

', another speaker. There was time for 25 of the 41 persons who requested an opportunity to speak that evening.

t Following a misunderstanding as to the availability of the William Penn Memorial Musei.rn on March 11, 1981, Administrative Judge Ivan Smith sought to extend the opportunity for limited appearance statements by est2blishing a general policy of permitting such appearances at the hearing room. To avoid delaying completion of the hearing, Judge Smith required that parties wishing to make such appearances do so by appointment. The Board tried to reach those who were not reached on March 5, and several have since made their statements or have arranged to do so.

For your information, the Comnission's rules authorize limited appear-ances prior to the start of our hearings. Our Board members, and particu-larly Judge Smith, view these statements as a valuable opportunity to iden-tify issues and concerns that should be addressed in the hearing.

l Consequently, at the outset of the TMI proceeding, three days of such appearances were held in November 1980, two in Hershey, Pennsylvania, and e

one day at The Fortn in Harrisburg, which as you know holds some 2,000 people.

Normally, limited appearances are not held after the hearing Commences.

I Nevertheless, Judge Smit' felt that additional limited appearances might be beneficial because of the importance of the TMI proceeding and the length of the hearing, which has now extended six months, essentially with-out interruption.

Consequently, the March 5 and March 11 dates were ar-ranged wi" H assistance of some of the intervenors. Since the March 11 date har' cancelled, Judge Smith made the alternate arrangements.

In the fifteen working days since the date of the press release an-nouncing alternate arrangements, some ten persons have appeared or have

  • been scheduled to appear before the licensing board. The decoru= of the hearing room enhances the impact of such statements by permitting them to be heard without the distraction attendant on a large, sometimes impas-sioned group'. These appearances are normally scheduled for 5:00 p.m. or after, thereby maximizing the opportunity for working people to speak.

Parking at the 5:00 p.m. session is plentiful, convenient and costs only

', fifty cents. Special arrangements are made for those who cannot attend the j 5:00 p.m. session.

It should also be observed that members of the public may make written limited appearance statements at any time. Written statements are carefully read by the Board and entered in the public record. They have the same effects as oral statements.
