GENERAL ELECTRIC'S RESPONSE TO PCCI MOTION FOR RECONSIDERATION AND COMPLETION OF ANSWER 1

'ss General Electric (GE) hereby responds to PCCI's __-

Motion for Reconsideration and Completion of Answer, dated April 13, 1981, as follows:

1. PCCI makes two basic points in support of its Motion for Reconsideration and Completion of Answer: a) that the GE I contracts are clearly relevant to this proceeding (PCCI Motion at 2), and b) that GE's proposed form of protective order is unduly and prejudicially restrictive (PCCI Answer at 4). In what follows, it will be

! demonstrated that neither point has merit, and the Board should deny PCCI's Motion and grant GE's Motion for a Protective Order.

2. PCCI has continued to ignore the Board's admonitions l

that it should establish the elements of relevancy necessary to permit the Board's ordering the production

of the documents (Board Memorandum and Order, dated February 12, 1981, at 2.). PCCI's Limited Reply, dated November 24, 1981, was obviously insufficient to establish these elements, in spite of the Board's invitation, if not urging, that PCCI do so. Having failed to do so, PCCI has moved for reconsideration of the Board's March 31, 1981 Memorandum and Order.

More significantly, PCCI's Motion rests upon its often repeated assertions to the effect that the documents are " clearly relevant." Having twice failed to establish this element by means of similar assertions, PCCI cannot hope to sustain its Motion for Reconsideration.

GE submits that the Board should deny PCCI's Motion.

3. As for the proposed form of Protective Order, it is curious that PCCI finds it unduly and prejudicially restrictive, since this is the form of protective l

order sanctioned by the Appeal Board in Wolf Creek.
