APPENDIX A NOTICE OF VIOLATION Power Authority of the State of New York J. A. Fitzpatrick Nuclear Power Plant Docket No. 50-333 Based on the results of an NRC inspection conducted on November 6,1980 of the shipment of radioactive waste which was shipped from your facility on or about November 4,1980, it appears that one of your activities was not conducted in full compliance with federal regulations and the conditions of your NRC facility license DPR-59 as indicated below.
10 CFR 71.5 requires that no licensee shall deliver licensed material to a carrier for transport unless the licensce complies with applicable regulations of the Department of Transportation in 49 CFR Part 170-189.
49 CFR 172.504(a). states that "...each motor vehicle...must be placarded on each end and each side...."
Contrary to the above, one shipment of radioactive material designated by SSR #23406 carried by Tri-State Motor Transport trailer #012 (Tractor
- 5351 arrived at the Chem-Nuclear burial site at Barnwell, South Carolina on Noyember 6,1980, without the prescribed RADI0 ACTIVE placard on the front of the tractor or the front of the trailer.
This is a Severity Level IV Violation.
