On September 19, 1980 the Comission approved the new Part 72 to Title it of the Code of Federal Regulations, entitled, " Licensing Requirements for the Storage of Spent Fuel in an Independent Spent Fuel Storage Installation."
Part 72 was published in the Federal Register today and becomes effective thirty (30) days after publication.
In the supplementary information in the Federal Register Notice, the Comission discusses issues addressed in public comments.on the draft rule.
Item 33 of those comments,, " Licensing Actions Involving Previously Licensed Facilities," states that the GE Morris license renewal, currently under review, "will proceed pursuant to 10 CFR Part 72."
On October 28, 1980, an advance copy of 10 CFR Part' 72 was distributed by NRC staff counsel to the parties to the license renewal proceedings.
Accordingly, the NRC staff is now reviewing your application under the new regulation,10 CFR Part 72. Our preliminary review of 10 CFR Part 72 indicates that the following sections contain requirements which either are not found in or differ from those in 10 CFR Parts 30, 40, and 70: 72.11(b),
72.14(c), 72.17(d), 72.20, 72.33(4) & (5), 72.72(c), 72.76, and all of Subpart I.
We request that you confirm your intention to pursue your application for renewal of Materials License SNM-1265.
If you intend to pursue your l
application for renewal, it will be necessary for you to provide specific i
information on each section noted above. Further, it would be helpful if l
you would identify those sections and paragraphs of your Consolidated Safety Analysis Report (CSAR), NED0-21236C, which you believe satisfy each l
and'every requirement of the new regulation.

General Electric Company h'0V 121980 We also note that 10 CFR Sections 72.16 and 72.33 require that an applicant propose technical specifications for safe operation of a spent fuel storage facility. The operation specifications presently contained in Section 10 of your CSAR rnd any additional specifications derived from the requirements of the new regulation will become the technical specifications for the Morris Operation. Therefore, when considering the requirements of 10 CFR Part 72, also make a detennination as to the need for any additional technical specifications.
