On October 9, 1980, the Depar tment of Justice ("Depar tment" )

received the Initial Trial Brief of the Public Utilities Board of Brownsville, Texas ("Br ief").

Under the Licensing Board's Order of September 8, 1980, parties may file responses to Brownsville's Brief by October 22, 1980.

It is the position of the Department that no response to the Motion'is necessary unless and until the Board directs the par ties to do so. 2/
