On August 26, 1980, the Nuclear Regulatory Commission published in the Federal Register (45 Fed. Reg. 56956) notice of opportunity for a hearing on the application for operating licenses for the Callaway Plant, Units 1 and 2.

On September 22, 1980, Treva J. Hearne, Assistant General Counsel for the Missouri Public Service Commission, filed a document entitled " Petition for Leave to Intervene as Representative of State Pursuant to Title 10 Section 2.715(c)

Code of Federal Regulations (C.F.R.)."

In the event that a hearing is held to consider the application for operating licenses for the Callaway Plant, Units 1 and 2, the Nuclear Regulatory Commission Staff would support the petition of Public Service Commission 8010160540 6

of Missouri to appear as the representative of an interested state pursuant to 10 C.F.R.12.715(c) and would welcome its participation in the matter.- Y Respectfully submitted, 7,.

t MThe St 'ff notes, however, that in an operating license proceeding, unlike a cons.";ction permit proceeding, a hearing is not mandatory and will not be convened in the absence of a finding by the Board of a bona fide intervenor, an individual or entity who has filed a petition for leave to intervene pursuant to 10 C.F.R. 52.714 and satisfied the requirements of that section including the requirement of advancing at least one good contention.
