Dear Members of the Board:

The NRC Staff is today filing its first set of interrogatories and document requests to Nuclear Engineering Co., Inc. This filin3 is being made pursuant to the schedule contained in this Board's "Prehearing Conference Order And Order Setting Time For Discovery." As indicated in the " Motion By The NRC Staff For Clarification Of Prehearing Conference Order and Order Setting Time For Discovery" filed September 23, 1980, the Board's present schedule does not presently provide for follow-up discovery or depositions. As the Board has not yet ruled upon the apparently unopposed Staff motion, the Staff is faced with the choice of noticing depositions without the receipt of initial interrogatory responses or_ initial production of documents. Since such a course of action would neither be efficient or productive, the Staff hopes to engage in such follow-up discovery after the Board has modified the present discovery schedule pursuant to a motion to do so, or upon other action by the Board.
