Gentienen:

On Monday, January 3, 1977, Counsel for Licensee received a copy

.of the Staff' memorandum referred to above. In its review of that memcrandum, Licensee noticed-that there was a factual mis-statement at pases six a~nd'seven'thereof which states:

'It should be pointed out that the' fact that th e ' Dott Michigan Div1'sion decision was unfavorable to the Midland N uns clearly laid out ~in Board. Exhibits 1 and 2.6_/ uclear (Admitted Plant into evidence at Tr. 293). These exhibits were made available to all partiec~under the-Notice of Availability of Documents for Inspection (see. footnote 3) as of November 5, 1976-(Tr. 268).

Hence, this'information'w'as available to the parties nearly,-one full month priorJto Mr. . Temple's taking .the stand lat the evidentuary hearing in Midland.
