Dear Mr. Coufal:
At the prehearing conference in the above matter whit took place in Chicago on December 14, 1976, Mr. Wessel stated that " subject to confirmation, Mr. Paul Oreffice, President of Dow Chemical U.S.A.,
would be available to testify on January 19 (Tr., p. 969).
As a result of inte.rvening events, Mr. Oreffice has had to change his schedule, and will not be available on January 19.
However, he has arranged his schedule so that he will be available the-tollowing week, on January 26.

It appears that this change will not in any way delay or hamper these' proceedings.
There is disagreement among some of the parries over the scheduling of witnesses and other matters. Resolution of these problems i
could well take both Januhry 18 and 19, chus' cutting into the time Mr. Oreffice would be available for cross-examination. Hopefully, with Mr. Oreffice being'available.the following week, all parties and the Board will have ample opportunity to ask Mr. Oreffice whatever questions they may have..
I understand that there have been differences between Consumers and the other intervenors, as to who will be called to testify during the week of' January 18.
Dow has no obj ection to the schedule suggested ~
by Mr. Cherry in tha penultimate paragraph of his December 29 letter.
However, Mr. Temple will be available to testify that week if called.
- Fe will await further instructions or advice.
