SUMMARY

DISPOSITION AND PREFILED TESTIMONY On May 7,1981, the Staff and Applicant filed separate motions for summary disposition of certain contentions admitted on behalf of Intervener Bursey.

On May 27, 1981, then Intervenor Fairfield United Action (FUA) served responses in opposition to summary disposition of three such contentions.

On May 28, 1981, FUA served prefiled testimony of two prospective witnesses on then FUA Contention 8.

On June 1, 1981, the Appecl Board reversed this Board's April 30, 1981 order granting FUA's late intervention petition. With the loss of party status, the above-referenced filings of FUA are rendered a nullity.

Nonetheless, in order to avoid any confusion in the record, the Staff hereby moves that FUA's May 27, 1981 response to summary disposition and May 28, 1981 prefiled testimony be stricken from the record of this proceeding.
