Dear Judge Wolfe:

The iiRC Staff has received a letter addressed to you from James torgan Scott, Jr., Counsel for TEXPIRG, dated April 16, 1981.

This letter was in response to the Board's Order of April 7,1931, which ruled that Mr. Scott could not testify as an expert witness for TEXPIRG and still remain as its attorney.

Mr. Scott's letter simply asked the Board to reconsider its decision with regard to the attorney / witness conflict without any supporting argument.

A petition filed with a Licensing Board seeking reconsideration of one of its rulings must state specifically the respects in which the ruling is clained to be erroneous, the grounds of the petition, and the relief sought.

Since

Scott's letter is not labelled as a " Petition for Reconsideration," does not state in wnich respects the decision is erroneous, sets forth no supporting or legal argunents, and does not identify the relief sought, the NRC Staff does not consider the letter to be a proper petition for reconsiderauion under the Commission's Rules of Practice. Accordingly, we believe that no response is necessary on our part, and that the Board can 81 o soi o //6
