SUA SPONTE REVIEW We have conducted a preliminary review of the impact of sua soonte review

, originally constituted in its present form) and the present.

- i. preliminary review has disclosed the following:
1.
Of 57 operating licenses issued since January 1, 1972, 27 were issued l
~
result of contested proceedings.
(See Attachment 1.)
Of those as a l
27 units,10 were ready to load fuel before issuance of the full power license initial decision.
However, all 10 had been issued low power licenses, and in many of these cases the initial decision on full power was com;,licated because the Boards had to review new environmental requirements steming from the Calvert. Cliffs decision issued July 23, 1971, and the issuance of Appendix D to Part 50 on September 9, 1971.

Based on our review of Initial Decisions, in all the foregoing contested proceedings, sua sponte questions went to hearing in only s'ix - -....
instances.
In three of those six instances, material conditions were e
imposed on the ' operating licenses by the Boards. (See Attachment 2.)
3.
Of 13 active operating license proceedings expected to go into hearing and decision in the next 18 months, only four proceedings currently have sua sponte questions under consideration.
These 13 proceedings concern operating licenses for 21 units.
We believe that this preliminary examination shows a cautious, if. not parsimonious, use of sua sconte authority by the Boards.
We believe further that sua sponte has resulted in meaningful improvements in the public health and safety in at least half the six cases where it was employed.
