Kline March 25, 1981 Page Two As I explained at the conference, the written response is to Joint Intervenors' Contention 2 as presented in their amended petition of March 6, 1981. Joint Intervenors filed a revised version of Contention 2 at the prehearing conference on March 24. Applicant's written response is still applicable to the introductory four paragraphs of the revised Contention 2 and to paragraph "F" (addressed as "2.G" in Applicant's response).

While Applicant did not object to the litigation of paragraph "I" of the revised contention, please see Applicant's written comments (labeled "2.K") on the litigation of low-level radiation health effects.

An acceptable basis will be that material new information has arisen which has not known, or could not with reasonable dili-Jence have been known, at the time set for discovery, and that the untimely request was filed within 30 days after the new information became known or with reasonable diligence should have become known.
