Dear Mr. Bursey:
At the conclusion of our informal meeting following the prehearing conference on November 25, 1980, you made a remark to the effect that you would be announcing in a press con-ference that you were pursuing five contentions in the NRC proceeding, (rather than the six discussed prior to and at the prehearing) and explained that you did not plan to discuss your ATWS contention.
It was not entirely clear to us whether you meant that you did not plan to feature the ATWS contention at your press conference or whether instead ye1 meant that you did not plan to pursue the ATWS contention in the NRC proceeding.
One member of our group is quite sure that you incended to advise us that you were dropping the ATWS contention in the NRC proceeding.
If indeed that is the case, we, and, I am sure, the NRC Staff and the Licensing Board, would want to be advised at the earliest possible date.
For your convenience in replying, I have set forth below alternative responses confirming or denying that you are abandoning contention A3 pertaining to Anticipated Transients Without Scram.
A duplicate copy is provided for your retention.
