Dear Mr. Smith:
On December 23, 1975, Alabama Power Company (" Applicant")
in a filing with the Atomic Safety and Licensing Board (" Board")
withdrew the construction permit applications for Units 3 and 4 of its then proposed Alan R. Barton Nuclear Plant ("Barton Plant").
The reasons for the withdrawal included increases in construction cost estimates and the downward revision of forecast loads (both demand and energy) which required a revision of the construction ~
l program for new generating plants. At that--time , no construction.
l had begun, nor has any construction proceeded since that time.
l The Nuclear Regulatory Commission ("NRC") Staff concurred in the withdrawal in a January 5, 1976 communication.
l At the time of the December 1975 withdrawal of the application for Units 3 and 4 of the Barton Plant, Applicant indicated it was proceeding on a revised schedule with its application for Units 1 and 2 of the Barton Plant. Subse-quently, on November 18, 1977, Applicant advised NRC that the Applicant's Board of Directors had cancelled the plans to l

necessity for the Barton Plant to the Alabama Public Service Commission.
NRC, in a February 2, 1978, letter to Congressman John D. Dingell acknowledged receipt of notice of cancella-tion of plans to build Units 1 and 2 and advised Congress thatit had discontinued review of the Barton Plant applica-tion as of early 1976.
Accordingly, pursuant to Section 2.107 of NRC Rules of Practice, and in light of the above, Applicant respectfully requests that the Board formally acknowledge withdrawal of the applications for all units cf the Barton Plant.
