Dear Mr. Cosgrove:

Your letter of September 26, 1980 to President Carter, regarding the operation of Three Mile Island Unit 1, and funding for the cleanup of Unit 2, has been referred to me for response.

On July 2,1979, the Comission ordered that TMI-1 remain in a cold shutdown condition until further order by the Comission and stated that a public hearing would be held prior to restart.

l On August 9,1979, the Commission issued an additional Order on 1MI-1 specifying the basis for the shutdown order, and the procedures to govern the hearing regarding restart. On the basis of this hearing, the Commission l

will detemine whether further operation of TMI-1 will be pemitted, and if so, under what conditions.

I have enclosed a copy of the August 9,1979, j

Order for your information.

The Commission's Order also identifies a number of items that must be resolved prior to restart. These items, which are listed on pages 5-7 of the Order, i

include and go beyond those required for restart of other Babcock & Wilcox-i design pressurized water reactors similiar to TMI Units 1 and 2.

These addi-tional items included those recommended by the Lessons Learned Task Force l

which studied the TMI accident and made recomendations for improvements to existing and new nuclear power plants.

The TMI-1 hearing began October 15, 1980, at the Nuclear Regulatory Commission Hearing Room, 25 North Court Street Harrisburg, Pennsylvania, and is currently i

in progress.

j With regard to Federal funding of TMI-2 cleanup activities, under the Atomic Energy Act of 1954, as amended, NRC has the statutory authority to ensure that i

the public health and safety will be protected should Metropolitan Edison Company be unable to carry out its responsibility for decontamination operations at TMI-2.

A number of options are possible, including NRC licensing another organization to run the ' facility or NRC operating the facility itself. NRC is currently i

preparing a contingency study considering this possibility. At present, however, l

the resources necessary for NRC to implement its direct involvement in Metropolitan Edison activities are not authorized and our existing statutory authority does l

not provide a basis for governmental assistance to GPU.
