POSSESSION LEVEL OF SNM ON SNM-960

Dear Mr. Partlow:
On August 4,1980, we shipped 598 grams of Plutonium to Los Alamos National Scientific Laboratory. Since that time, the possession level for SNM-960 has remained well below one effective kilogram, as defined in 10 CFR 70.4(t). For the foreseeable future, there are neither plans nor projects which will require our total holdings of SNM, Under SNM-960, to exceed one effective kilogram.
Granted that the licensed level under SNM-960 exceeds the effective kilogram, we would ask you to replace Sections 1 through 8 of the MPP-2 Amendment to SNM-960, with one license condition. We suggest the following:
"Notwithstanding the licensed holding limits for License SNM-960, the licensee shall not possess SNM in a quantity equal to or greater than one effective kilogram as defined in 10 CFR 70.4(t). Moreover, the licensee may address the regulations of 10 CFR Part 70 as though licensed to possess less than one effective kilogram."
