That NRC has received the enclosed letter from Mr. Corald F. Hayes, Director of Office of Emergency Preparedness and Civil Defense for the town of Plymouth, Massachusetts which refluts Mr. Hayes' concern that Boston Edison is excluding his office from the local emergency planning efforts around the Pilgrim Nuclear Power Station concentrating all their planning efforts at the State level.

As you may know, Flymouth is only one of several towns within the Pilgrim' Station's plume exposure EPZ and, if the conurne empressed are valid, it may be the forerusiner of a much larger problem. To insure that acequate planning is being performed at the local level, we requeet: that FEVA review the local planning efforts in the environs of the Pilgrim eite to determine the adequacy of the support and cooperation from Boston Edison and the scope of its effort. A reeting between the NRC, FEMA, Boston Edison and officials from those communi $1es within the plume exposure EPZ either having a response role or who are otherwise affected by the planning effort may be necessary to resolve this problem.

We have informed Boston Idison of our comenen for the implications of lack of cooperation on their part as indicated in Mr. Hayes' letter and of this request to your office.

Dear Sir:

I find that I must again protest to you personally concerning the attitude of certain Boston Edison personnel and their lack of coopera-t ion with the Town of Plymouth and, in particular, this office.

The legal responsibility for protecting our citizens rests, by statute, with the Chief Elected Official of the Town of Plymouth. As his agent, and the person charged with preparing and implementin; ade-quate plans to protect the people of our community, I must strongly pro-test the efforts of Doston Edison to exclude us from this planning pro-cess while you concent rate all your planning efforts at the State le ve l.

I would call your attention to the plan submitted to the United States Noelear Regulatory Commis3 ion for approval which states the primary res-ponsibility for resnonding to an accident at the Pilgrim Nuc lear Power Stat ion lies with the emergency forces of the Town of Plymouth, not the State. The State 's role, in an emergency, is one of support to the Town.

It is che re fore impe ra t ive that this department be notified innedia te ly of any inc ident, problem or cccurrence at the Pilgrim Nucicar Power Sta-tion that could lead to (though it may not be) any release of radioactive ma terials into the atmosphere of the Tot.n of Plymouth.

In spite of repeated requests to be notified of probips which could Icad to a hazard to the citizens of this community, I find that i must still receive this information, long af ter the fact, f om the news media.

For the past eighteen months, I have repeatedly asked to be notified by Boston Edison of fic ials of any and all incidents at the Pilgrim Nuclear Powe r S t a t ion. As a result of these requests, I have been lied to, and, at t ime s, totally ignored.

The most rec e n t problen at the powe r stat ion was considered se rious enough for Boston Edison to notify the Massachusetts Department of Public Ilealth and to issue a press release and yet not serious enough to notify the local agencies most responsible for protecting the people of Plynouth (i.e.- Plynnuth Police and Plymouth Civil Defense).

Sk. Armstrong informed me that his procedures did not specify notification of local officials and would not discuss it any further. Evidently, Mr. Armstrong's procedures are different from the notification procedures supplied to this office by Boston Edison because our copy specifies noti-fication of the Plymouth Civil Defense via the Plymouth Police.

Af ter my conversation with Mr. Armstrong, I then called Mr. Tis to see if he could explain the reason for not notifying us.

rtr. Tis was not in at the time and I requested Mr. Gaughan to have Mr. Tis contact me as I felt this was a very serious breach of agreement between this office and Boston Edison.

Mr. Tis did not return ny call so I again te le phoned his office and he was in his office.

I spoke to hin about the situation and still did not receive an adequate answer to the question of notification.

I have made myself available to Boston Edison at all times for plan-ning purposes and have received little cooperation in return.

I find this to be a condition that should not and will not be tolerated by this office any longer.

I would hope that you will take steps immediately to correct this situation before something serious happens at the powe r station that the Town will be unable to respond to because we were not notified in time.
