CLARIFICATION OF NOTICE OF RECEIPT OF APPLICATION FOR FACILITY OPERATING LICENSES: CONSIDERATION OF ISSUANCE OF FACILITY OPERATING LICENSE AND NOTICE OF CPPORTUNITY FOR HEARING
.i On August 26, 1980 the Nuclear Regulatory Comission (the Comission) published in the _ Federal Register a notice of " Receipt of Application for Facility Operating s
Licenses; Consioeration of Issuance of Facility Operating Licenses and Notice of Opportunity for Hearing with respect to Units 1 and 2 of the Callaway Plant,"
45 Fed. Reg. 56956. This hotice clarifies and supersedes that Notice concerning Union Electric Company -(the Applicant).
Notice is hereby given that-the Comission, by letter dated October 1,1980, was advised by the Applicant that it is only seeking the issuance at this tin.e of an operating license for Callaway Plant, Unit 1.
The Environmental Report was filed on October 19, 1979, and includes information on the environmental effects of the operation of Callaway Units 1 and 2.
However, the Applicant states that it is not now seeking an operating license for Callaway Plant Unit 2.
The Applicant l
does not anticipate that construction of Callaway, Unit 2, will be ccmpleted before late 1987. ~Upon receipt of an application for Unit 2, a separate notice of receipt will be published by the Comission including an appropriate notice of opportunity to request a hearing with respect to the Operating t.icense appli-cation for that Unit.
Accordingly, the Comission is re-issuing and superseding its August 26, 1980 Federal Register notice'to reflect this fact.

j Notice is hereby-given that the Commission has received from the applicant an application for a facility operating license to possess, use and operate the Callaway Plant, Unit 1.
The Callaway Plant, Unit 1 is a pressurized water
-nuclear reactor to be located on the applicant's site in Callaway County, I
i Missouri. The reactor is designed to operate at a core power level of 3411
]
megawatts thermal, with an equivalent net-electrical output of approximately j
1150 megawatts. Construction of the unit was authorized by Construction Permit No.- CPPR-139 issued by the Commission on April 6,1976. The NRC Staff presently anticipates that construction of Unit I will be completed by February of 1983.

- located on the ficodplain; (3) the receipt of a record on the applicant's application for a facility operating license by the Advisory Committee on Reactor Safeguards; and (4) a finding by the Commission that the application for the facility license as amended complies with the requirements of the Atomic Energy Act of 1954, as amended (the Act) and the Commission's regulations in 10 C.F.R. Chapter I.
Prior to issuance of any operating license-for the Callaway Plant, Unit 1, the Comnission will inspect the facility to determine whether it has been constructed in accordance-with the application, as amended, and the provisions of the construction permit. In addition, the license will not be issued until the Commission has made the findings reflecting its review of the application under the Act, which will be set forth in the proposed license, and has con-cluded that the issuance of the license will not be inimical to the common defense and security or to the health and safety of the public. Upon issuance of the license, the applicant will be required to execute an indemnity agree-ment as required by Section 170 of the Act and 10 C.F.R. Part 140 of the a
Commission's regulations.

4-Requests for a hearing and petitions for leave to intervene shall be filed in i
accordance with the Ccmmission's " Rules and Practice for Domestic Licensing Proceedings" in 10 C.F.R. Part 2.
If a request for a hearing or petition for leave to intervene is filed by the above date, the Atomic Safety and Licensing Board, previously designated by the Chairman of the Atomic Safety and Licensing
- Board Panel, will rule on the request.and/or petition and the designated Atomic Safety ano Licensing Board will issue a notice of hearing or an appropriate order.. Any person who previously filed a petition for leave to intervene or request for a hearing in response to the August 26, 1980 Federal Register notice need not refile pursuant to this Notice. However, as stated in the second paragraph of this Notice, the notice of opportunity for-hearing applies to Callaway Plant Unit I only.
