Dear Mr. Smith:

Your letter to Mr. Denton about reopening the Three Mile Island nuclear sta-j tion v-s referred to me for response. I regret that this answer to your letter has baon delayed. The accident and its consequences have created a substantial increase in the agency's workload, which has prevented me from responding to you as promptly as I would have liked.

On July 2,1979, the Commission ordered that TMI-1 remain in a cold shutdown condition until further order by the Commission and stated that a public hearing would be held prior to restart of TMI-1. The Commission believes that public participation is a vital ingredient in matters related to TMI-1 restart plans.

On August 9,1979, the Coamission issued an additional Order on T:11-1 specifying the basis fr

'% Shutdown Order and the procedures to goven, the hearing regard-ing restar

_ basis of this hearing, the Comission will detemine whether any furths

,vration of TMI-1 will be pemitted and, if so, under what condi-tions.

I nave enclosed a copy of the August 9,1979, 0. der for your infomation.

The Cmmission's Order also identifies a number of itens that must be resolved prior to restart. These items, which are listed on pages 5-7 of the Order, in-clude but go beyond those required for restart of other Babcock & Wilcox-design pressurized water reactors similar to TMI Units 1 and 2.

These additional itcas include those reconmended by the Lessons Learned Task Force, which studied the accident at TMI.

The Comission carefully considered the time required for completing all tasks related to the Order.

(A Comission schedule calling for expeditious handling of the necessary NRC staff and procedural actions required for the hearing process is provided on the last page of the Commission's Order.) Based on that schedule, I do not believe that the restart of T}il-1 could occur until sometime in 1931.

As for Unit 2, the licensee has not yet sutInitted to the NRC a proposal for over-all plant recovery, although the licensee is conducting feasibility studies.

2-be subnitted or how much time will be needed for the required reviews and approvals in connection with Unit 2's recovery. I would note, however, that the licensee's authority te operate Unit 2, except for those actions neces-sary to keep the reactor shat down, was suspended by Order of July 20, 1979.
